These Terms and Conditions govern the provision of gardening and related services by Gardeners Newbury Park to customers within the United Kingdom. By making a booking, accepting a quotation, or allowing work to commence, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions shall have the following meanings:

Customer means the person, company or organisation that requests or receives services from Gardeners Newbury Park.

Services means gardening, garden maintenance, clearance, landscaping, or any other work provided by Gardeners Newbury Park as agreed with the Customer.

Agreement means the contract between the Customer and Gardeners Newbury Park incorporating these Terms and Conditions and any written quotation or confirmation.

2. Scope of Services

Gardeners Newbury Park provides a range of gardening and outdoor maintenance services, including but not limited to lawn care, hedge trimming, planting, weeding, garden tidy-ups, garden clearance, and minor landscaping works. The exact scope of the Services for each Customer will be described in the quotation, booking confirmation, or written agreement.

Any additional work requested by the Customer that is not covered in the original quotation or agreement may be subject to an additional charge, which will be confirmed with the Customer before such work is carried out.

3. Booking Process

Bookings may be requested by the Customer through any contact method made available by Gardeners Newbury Park. A booking is not confirmed until it has been explicitly accepted and scheduled by Gardeners Newbury Park and the Customer has received a confirmation of the appointment details.

Gardeners Newbury Park may provide an estimated time of arrival for the gardening team. This is an estimate only and may vary due to traffic, weather, or other operational factors. The Customer agrees to provide accurate information when making a booking, including access details, the nature of the work required, and any relevant site conditions.

For larger or ongoing projects, a site visit or assessment may be required before a final quotation is issued. Such visits do not oblige either party to proceed unless and until the quotation is accepted.

4. Quotations and Pricing

Quotations are based on the information provided by the Customer and any site inspection carried out by Gardeners Newbury Park. Prices may be quoted as a fixed price for a specific project or as an hourly or daily rate, depending on the type of work and the agreement with the Customer.

All quotations are valid for a limited period from the date of issue, as stated in the quotation, after which Gardeners Newbury Park reserves the right to revise the price. Any changes in the scope of work, access, or site conditions may result in an adjustment to the quoted price, which will be communicated to the Customer.

5. Access and Customer Obligations

The Customer must ensure that Gardeners Newbury Park has safe and reasonable access to the property and the areas where the Services are to be carried out at the agreed times. This includes providing keys, codes, or being present to allow entry as required.

The Customer is responsible for informing Gardeners Newbury Park of any hazards, restrictions, or special requirements at the property, including but not limited to pets, fragile plants or structures, uneven ground, or buried utilities. Gardeners Newbury Park will not be liable for any delay or inability to perform the Services where access is restricted or conditions are unsafe.

If access is not available on arrival, or if the team is unable to start work for reasons beyond Gardeners Newbury Park's control, a call-out or cancellation charge may apply as described in the cancellation section below.

6. Payments and Invoicing

Payment terms will be confirmed at the time of booking or in the quotation. Unless otherwise agreed in writing, payment for one-off or short-term work is due on completion of the Services. For ongoing maintenance or longer projects, Gardeners Newbury Park may require payment in stages or on a recurring schedule.

Accepted payment methods will be indicated in your quotation or invoice and may include card, bank transfer, or other commonly used payment methods in the United Kingdom. Gardeners Newbury Park does not accept responsibility for payments sent through unapproved channels.

Where payment is not made on the due date, Gardeners Newbury Park reserves the right to charge interest on overdue sums in accordance with applicable UK legislation and to suspend or cancel further Services until payment has been received in full.

7. Cancellations and Rescheduling

The Customer may cancel or reschedule a booking by giving notice to Gardeners Newbury Park. To avoid cancellation charges, the Customer should provide reasonable notice, typically at least 24 to 48 hours before the scheduled appointment time, or such other notice period as may be stated in the quotation or booking confirmation.

If the Customer cancels or reschedules with less notice than required, Gardeners Newbury Park may charge a late cancellation fee to cover costs incurred, including staff and travel costs. If the team attends the property and is unable to gain access or commence work for reasons beyond their control, this may be treated as a late cancellation.

Gardeners Newbury Park reserves the right to cancel or reschedule a booking in the event of severe weather, staff illness, safety concerns, or other circumstances beyond its reasonable control. In such cases, Gardeners Newbury Park will seek to provide as much notice as possible and to agree a new appointment time with the Customer.

8. Customer Satisfaction and Complaints

Gardeners Newbury Park aims to provide a high standard of service. The Customer should inspect the work as soon as reasonably possible after completion. If the Customer is not satisfied with any aspect of the Services, they should raise the issue promptly so that Gardeners Newbury Park has an opportunity to investigate and, where appropriate, rectify the matter.

Complaints should be made within a reasonable time after the work has been carried out. Gardeners Newbury Park will consider each complaint fairly and may request further information or a site visit in order to assess the situation.

9. Waste Removal and Environmental Regulations

Gardeners Newbury Park operates in accordance with applicable waste and environmental regulations in the United Kingdom. Garden waste arising from the Services may either be left on site for the Customer to dispose of, or removed by Gardeners Newbury Park, depending on what has been agreed in advance.

Where waste removal is included, this will be specified in the quotation or booking confirmation and may be subject to an additional charge based on the volume and type of waste. Gardeners Newbury Park will handle and transport green waste and any other materials in compliance with relevant legislation and licensing requirements.

The Customer agrees not to request removal of hazardous, prohibited, or contaminated waste materials and to inform Gardeners Newbury Park of any concerns regarding soil contamination, invasive species, or similar issues. Gardeners Newbury Park reserves the right to refuse to remove any material that cannot lawfully or safely be transported or disposed of.

10. Use of Materials and Plants

Where Gardeners Newbury Park supplies plants, materials, or other products as part of the Services, these will be of a standard suitable for the intended purpose. Variations may occur in colour, size, or appearance due to the natural characteristics of plants and outdoor materials.

Any guarantees regarding the survival or performance of plants are subject to appropriate ongoing care by the Customer and to factors beyond the control of Gardeners Newbury Park, such as weather conditions, pests, and diseases. Gardeners Newbury Park does not accept liability for the failure of plants to thrive where reasonable care and external conditions are outside its control.

11. Health and Safety

Gardeners Newbury Park takes health and safety seriously and will carry out the Services in a manner that seeks to protect its staff, the Customer, and any third parties. The Customer agrees to cooperate with any reasonable health and safety requests, including keeping pets and children away from active work areas and equipment.

Gardeners Newbury Park may refuse to carry out or may suspend work if it considers that health and safety could be compromised. This may include unsafe structures, aggressive animals, hazardous materials, or extreme weather conditions.

12. Liability and Insurance

Gardeners Newbury Park will exercise reasonable skill and care in the provision of the Services. However, liability is limited as follows:

Gardeners Newbury Park shall not be liable for any indirect, consequential, or economic loss, including loss of profit, business, or opportunity arising out of or in connection with the Services.

Gardeners Newbury Park shall not be liable for any damage or loss resulting from inaccurate information provided by the Customer or from pre-existing defects or weaknesses in the property, structures, or plants.

In the event that Gardeners Newbury Park is found liable for any direct loss or damage to the Customer’s property caused by negligence, such liability will be limited to the reasonable cost of repair or replacement, up to a maximum amount covered by its applicable insurance policies.

Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, for fraud, or for any other matter that cannot lawfully be excluded or limited under UK law.

13. Delays and Events Beyond Our Control

Gardeners Newbury Park shall not be in breach of this Agreement nor liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances, or causes beyond its reasonable control. These may include extreme weather, accidents, transport disruption, public emergencies, or other force majeure events.

Where a delay occurs, Gardeners Newbury Park will use reasonable endeavours to resume the Services as soon as practicable and will keep the Customer informed where possible.

14. Data Protection and Privacy

Gardeners Newbury Park will collect and use personal information provided by the Customer for the purpose of managing bookings, delivering Services, and handling payments and communications. Personal data will be processed in accordance with applicable UK data protection laws.

The Customer is responsible for ensuring that the contact details and information they provide are accurate and kept up to date. Gardeners Newbury Park will not share personal information with third parties except where necessary to perform the Services, comply with legal obligations, or with the Customer’s consent.

15. Termination

Either party may terminate an ongoing service agreement by giving reasonable notice in writing, subject to any minimum term or notice period stated in the quotation or service schedule.

Gardeners Newbury Park may terminate the Agreement with immediate effect where the Customer fails to pay sums due, obstructs the performance of the Services, behaves abusively towards staff, or commits a serious breach of these Terms and Conditions.

16. Changes to These Terms

Gardeners Newbury Park may update or amend these Terms and Conditions from time to time. The latest version will apply to all new bookings and to ongoing Services after reasonable notice has been given to the Customer where required. Continued use of the Services following notification of changes will be taken as acceptance of the updated Terms and Conditions.

17. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.

Both Gardeners Newbury Park and the Customer agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or connected with these Terms and Conditions or the provision of the Services.

18. General Provisions

If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court or other competent authority, the remaining provisions shall continue in full force and effect.

No failure or delay by Gardeners Newbury Park in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

The Agreement is between Gardeners Newbury Park and the Customer and no other person shall have any rights to enforce any of its terms.

These Terms and Conditions, together with any quotation or written confirmation provided to the Customer, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence, or understandings.
